IMPORTANT – READ THESE TERMS CAREFULLY BEFORE ACCESSING THIS ASTM PRODUCT

These Terms of Use (“Terms”) govern access to and use of the ASTM Product by an Authorized User. These Terms are incorporated into and form part of the ASTM License Agreement for the ASTM Market Intelligence Platform (the “Agreement”) between ASTM International (“ASTM”) and the Licensee.

Capitalized terms not defined in these Terms have the meanings set forth in the Agreement. If you are entering into or accepting the Agreement on your own behalf, references to “Licensee” in these Terms include you.

By creating an account, accessing, or using the ASTM Product, you acknowledge and agree that: (a) you are an Authorized User under a valid Agreement; (b) if you are accessing the ASTM Product on behalf of a Licensee, you have authority to do so; and (c) you agree to comply with these Terms and the Agreement.

If you are the Licensee, you acknowledge that you are acting in both capacities as Licensee and Authorized User. If you do not agree, you may not access or use the ASTM Product.

Relationship to the Agreement

Your access to and use of the ASTM Product is governed primarily by the Agreement. Nothing in these Terms expands, limits, or modifies the rights or restrictions set forth in the Agreement. In the event of any conflict of these Terms and any other governing document relating to the ASTM Product, the Order of Precedence provision set forth in the Agreement shall control and determine the governing document.

Authorized User Responsibilities

Access to the ASTM Product is limited to individuals registered as Authorized Users under a valid Subscription Tier. Accounts are personal, issued on a named-user basis, and may not be shared.

As an Authorized User, you agree to:

  • Use the ASTM Product solely for the internal business purposes of the Licensee and strictly in accordance with the Agreement and the applicable Subscription Tier
  • Comply with all restrictions and limitations set forth in the Agreement
  • Comply with applicable laws in connection with your use of the ASTM Product
  • Maintain the confidentiality and security of your login credentials

You may not attempt to gain unauthorized access to the ASTM Product, other accounts, or related systems, nor may you circumvent technical access controls, security measures, or usage limitations.

The Licensee remains responsible for access to and use of the ASTM Product under its account, and your actions may be attributed to the Licensee under the Agreement, including where you are the Licensee.

Prohibited Uses

Any use of the ASTM Product, Content, or Derived Outputs beyond what is expressly permitted in the Agreement is prohibited.

Without limitation, you may not:

  • Provide any third party with access to the ASTM Product, or grant any sublicense, transfer, distribution right, or independent right to use the ASTM Product, Content, or Derived Outputs, except as expressly permitted under the Agreement
  • Download, extract, scrape, harvest, or systematically capture underlying data or Content from the ASTM Product except through functionality expressly enabled under the applicable Subscription Tier
  • Include Content or Derived Outputs in any external database, product, or service, or in any publication or distribution outside the scope expressly permitted under the Agreement
  • Use Content or Derived Outputs to develop, benchmark, train, validate, or enhance any competing product or service
  • Use Content, Derived Outputs, exports, graphs, images, or screenshots in connection with any artificial intelligence or machine learning system, including for training, fine-tuning, validation, or data ingestion
  • Interfere with or disrupt the operation, integrity, or performance of the ASTM Product

These restrictions are in addition to, and do not limit, the restrictions set forth in the Agreement.

Account Security and Monitoring

You must promptly notify ASTM and, if applicable, the Licensee administrator of any known or suspected unauthorized use of your account or breach of security.

ASTM may monitor use of the ASTM Product to verify compliance with the Agreement and these Terms, maintain security, and support operation of the ASTM Product, subject to the Agreement.

ASTM may suspend or disable an Authorized User account if it reasonably believes the account is being used in violation of the Agreement or these Terms.

Verified Company Indicators

Any “Verified” company checkmark displayed within the ASTM Product indicates limited review or confirmation of information provided directly by the company. It does not constitute endorsement, certification, ranking, recommendation, or warranty of any kind. ASTM may modify, revoke, or remove verification status at any time in its sole discretion.

Suspension and Termination of Access

Access to the ASTM Product may be suspended or terminated if:

  • The Licensee’s Subscription Term expires or is not renewed
  • ASTM determines that you have violated the Agreement or these Terms
  • Your use of the ASTM Product poses a security, legal, or operational risk

Upon suspension or termination, you must immediately cease all access to and use of the ASTM Product.

Updates to These Terms

ASTM may update these Terms from time to time. Updated Terms may be presented within the ASTM Product for review and affirmative acceptance. Continued access to the ASTM Product following presentation of updated Terms requires acceptance of the updated Terms.
